Terms of Service

Welcome to DataForce, a provider of season-long fantasy sports services which is owned and operated by DataForce, LLC. ("DataForce"). DataForce offers fantasy football services to you subject to these Terms of Service. ANY PARTICIPATION IN FANTASY FOOTBALL OR THE USE OF ANY DATAFORCE FANTASY SPORTS SERVICES WILL CONSTITUTE ACCEPTANCE OF THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO ABIDE BY THE ABOVE, PLEASE DO NOT PARTICIPATE IN FANTASY FOOTBALL OR USE THE FANTASY SPORTS SERVICES PROVIDED BY DATAFORCE.

Any changes to these terms will be noted on DataForce's home page for a period of not less than 30 days, and by an email burst to all of DataForce's customers.

By entering a Fantasy Contest, you are representing and warranting that you meet all of the below listed eligibility restrictions.

DataForce games are subject to the laws of each of the fifty states and Canada. We are able to offer money leagues to participants of legal age in most of the United States and Canada, including the District of Columbia. Void where prohibited by law.

Due to legal and licensing restrictions, persons located at time of entry in are not permitted to participate in our contests. Please use care in determining your eligibility; if you purchase teams in multi-year leagues and must discontinue play because of changing licensing restrictions in your state of residence, your deposit on the teams remains non-refundable. Your teams will be sold at the off-season auction and the sale price deposited into your account for withdrawal.

Minors under the age of eighteen may not join DataForce contests.

DataForce contests are intended for adults and are not directed to children. We do not knowingly collect personal information from anyone under the age of thirteen (13). If we become aware that we have collected personal information from a child under 13, we will delete it promptly. If you believe a child under 13 may have provided us personal information, please contact us at [email protected].

Employees of DataForce, LLC, its sponsors, subsidiaries, affiliates, advertising and promotional agencies are not eligible to play. Employees of Sideline Software (MyFantasyLeague.com) are not eligible to play. Any individual with access to non-public confidential information about our contests is not eligible to play.

If you do not meet the eligibility requirements of this section, then do not play in DataForce Fantasy Football leagues. DataForce may require you to provide proof of eligibility according to this section prior to receiving a prize.

To be eligible to play in any DataForce contest, you must register and maintain one and only one account with us. You may not use a second individual as a proxy to create another account for your own use. Excess accounts will be terminated by DataForce once discovered by our duplicate account detection software.

Once registered, you may enter multiple contests, but may only enter one team for each league. All entries must be paid before the draft or auction date of each contest. You will not receive a refund of entry fees after the contest has begun.

Holding multiple accounts is strictly forbidden, as is account sharing. One and only one account per person, please.

DataForce, in its sole discretion, may disqualify you from any DataForce contest or service, refuse to award fantasy points or prizes and require the return of any fantasy prize winnings, or suspend, limit, or terminate your account if you engage in conduct DataForce deems, in its sole discretion, to be of a fraudulent nature. This includes, but is not limited to:

• Falsifying personal information, including payment information, required to use the Services or claim a prize;
• Using IP proxying or other methods to spoof or disguise your location or the place of your residence to circumvent geographical restrictions on contest participation.
• Submitting a fantasy contest entry on behalf of any other person.

By signing up for fantasy football and/or fantasy sports services, you agree to DataForce's use of your personal information as described in DataForce's Privacy Policy, and you consent to allow DataForce to confirm your age and identity.

You agree that you are at least 18 years of age, and that if your resident state has a higher age restriction, you are at least the age required in your state's legal age policy to participate in fantasy sports.

When registering for online account access, you must provide a valid email address plus a unique username and password to be used with your account. You are responsible for maintaining the confidentiality of the username and password, and for restricting access to computers and mobile devices that have access to your account. You agree to keep your username and password confidential and to not share them with anyone else, and to immediately notify DataForce, LLC of any security breach including, but not limited to, unauthorized use of your username and password, or unauthorized use of your account. DataForce, LLC cannot and will not be held liable for any loss or damage arising from your failure to comply.

Notwithstanding anything in these Terms of Service, DataForce reserves the right in its sole discretion to terminate its services at any time for any reason, without notice to you, and provide you a full refund for any signup fees you may have paid to DataForce.

In the event that services are terminated under this provision, you acknowledge and agree that DataForce's sole liability to you will be for any signup Fees you may have paid, and not for any incidental, consequential, indirect, special or exemplary damages (even if DataForce has been advised of the possibility of such damages) arising from or relating to your involvement in, or DataForce's decision to terminate any services.

If (a) you charge back to your credit card the fees due under these Terms, (b) it appears you have engaged in cheating or manipulation of the Service, or (c) DataForce otherwise believes you have acted in a manner inconsistent with the spirit or the letter of the these Terms of Service, your Account may be suspended or cancelled immediately and all information contained within it immediately deleted or made inaccessible. DataForce may, but has no duty to, immediately terminate your access to its services if DataForce in its sole opinion concludes that you have provided false information in connection with your registration data. DataForce accepts no liability for information that is deleted due to the termination of your account.

An inactive account is one in which no financial transactions are made, and no fantasy teams are managed. A "transaction" occurs anytime money is deposited into the account, or purchase of a fantasy team is made from the account. If your account remains inactive for a period of two NFL seasons, it will be considered dormant.

Dormant accounts may be closed at our discretion. If an account contains a positive balance, and that money equals or exceeds the minimum balance required for submittal to your last known state of residence according its Unclaimed Property Law (usually $50) then after the required attempts to contact you according to your state, that money will be submitted to the appropriate state agency upon completion of its required dormancy period. Usually this means your money will become Unclaimed Property and submitted to your home state after three or five years of dormancy. Dormant accounts are zeroed out upon closure.

Each contest begins with its draft or auction, at the date and time listed, and continues for the length of the schedule defined in the rules for that contest. In the event the NFL schedule is altered, the term of the contest may be altered at the discretion of DataForce, LLC.

In the event that the NFL season is postponed, shortened or interrupted for any reason, DataForce, LLC reserves the right at our sole discretion to award prizes at the time the season is affected or to cancel, terminate, modify or suspend the contest.

All Contest lengths are official according to the length of the NFL regular season (excluding week 18, during which no fantasy games are played). If for any reason the NFL does not complete all games required for the fantasy playoff season (weeks 15-17 for most contests), the determination of winners in leagues with fantasy playoffs will be based on the season record of each team, if no fantasy playoff weeks have been played. If the fantasy playoffs have not yet begun in a Contender league, then prizes will be paid to individual contender leagues based upon standings, similar to regular leagues.

If one or more fantasy playoff games have been played before the NFL season is canceled, then all unplayed games will be considered a tie, with the remaining prize money shared between contestants still in contention.

The prize fund in Guillotine leagues will be shared evenly between all surviving teams.

The nature of Season-Long fantasy contests requires that a league be "full" before it can lock and begin play. The number of contestants for each league is displayed in the lobby under the "members" column.

Should DataForce be unable to fill a league before its scheduled draft date and time, the league will be canceled, and paid entry fees refunded to customers accounts in full.

Should the NFL season be suspended or delayed, all contests will pause and resume when the NFL season resumes. Should the NFL season be discontinued without planned resumption, with insufficient games played, DataForce fantasy football contests will likewise be declared canceled.

A "cancelled" season is one in which fewer than four (4) regular season games are played by the National Football League. These four games need not be played in consecutive weeks. Should the NFL season be cancelled (with fewer than four games played) for any reason, DataForce will refund all entry fees for single-year leagues, with the entry fees going back into customer accounts in the amount paid (cash and bonus money both). Customers may then submit a withdrawal request as desired. NFL playoff contests will likewise be cancelled and refunded if any NFL playoff game is not completed.

Entry fees for multi-year leagues are applied in full to the following year, including league deposits and regulatory fees such that the following year's contest is paid for in its entirety, whether those leagues are new start-up leagues or rolled over from a prior year. Draft positions in the following year will be determined randomly, rather than by contest results and/or potential points.

"Entry Fee" for refunding single-year leagues and playoff leagues is defined as the contest fee, and includes the annual cost plus any hosting fee, live draft fee and/or commissioner fee.

In order to manage your own gaming budget, you have the right to exclude yourself from any contests at DataForce, for any period of time and for any maximum expenditure. (Michigan residents must exclude for a minimum of 72 hours when participating in this feature.)

You have the right to restrict email or other advertising, as well as periodic newsletters, from DataForce.

You have the right to withdraw funds from your account at any time, with timely processing (DataForce will use reasonable efforts to process withdrawals within 72 hours), with the exception of any hold placed on your account by your state of residence, or by DataForce as a result of good-faith belief of fraudulent conduct.

You have the right to immediate availability of financial detail, including deposits, withdrawals, entry fees for playing history, prize winnings, and other adjustments to your account. DataForce, LLC will make itself available for a full explanation of any transaction.

You have the right to disable your account at any time, after first withdrawing any funds on account.

ALL STATISTICS AND OTHER INFORMATION PROVIDED BY DATAFORCE REGARDING ANY FANTASY SPORTS ARE UNOFFICIAL. Fantasy Football and their respective components are offered for informational and/or entertainment purposes only. While DataForce and the third parties used to provide the fantasy football and other fantasy sports services (the "Third Party Providers") use reasonable efforts to include accurate and up-to-date information, neither DataForce nor its Third Party Providers warrant or make any representations of any kind with respect to the information provided to you through the Fantasy Football services. DataForce and its Third Party Providers shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via its fantasy football or other fantasy sports services, and shall not be responsible or liable for any error or omissions in that information.

By joining a DataForce league, you indicate your availability and intent to competitively participate in the league. If participation ceases during the NFL season for multiple weeks, or participation ceases for multiple rounds during a draft, then after reasonable attempts to contact you and verify your intention of further participation, DataForce reserves the right to choose a replacement for you as owner of your team(s).

Participating in league management through methods such as automated computer scripts or other programming techniques designed to directly make changes to your teams on DataForce is forbidden, except as authorized by DataForce. However, you may use third-party sites and software to view without changing data, or to download league data.

"Prize money for each DataForce contest is held in a dedicated account maintained by DataForce Holdings, LLC, ▎ separate from the funds used to operate the business. Prize funds are not commingled with DataForce's operating ▎ capital. At the conclusion of each contest, prize winners are selected by DataForce according to the rules and prize structure of the contest. Each winning contestant is notified by email and prize money is made available for claiming. Once claimed, prize money is deposited into your DataForce account, where it may be withdrawn or used for additional contests. Cash prizes are awarded in U.S. dollars.

All prizes are awarded regardless of the number of entrants or amount of entry fees received. In the event that any legal authority challenges the awarding of any prizes to winners of DataForce Fantasy Football leagues, DataForce reserves the right in its sole discretion to determine whether or not to award such prizes.

Current identification must be (or have been) provided in order to claim prizes.

DataForce is not responsible for taxes on any money won by American citizens, and does not withhold income taxes. You are responsible for your own taxes. However, we may be required to withhold 30% for foreign citizens depending upon earnings (annual winnings minus entry fees for those contests). We adhere to the legal advice provided by DAEH LAW here.

All winners will be posted on the DataForce website and will be notified via e-mail by DataForce on the Thursday following the final game of the contest.

By accepting any prize, the winners grant permission to DataForce, LLC to use their names and/or likenesses for publicity and promotional purposes without further compensation, unless prohibited by law, and agree to execute a written consent. In the event of dispute about the identity of any entrant, entries made online are declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner can be required to provide the sponsors with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.

The User shall be responsible for, and assumes all liability associated with, any material made available via the Service under the User's Account, including liability for claims of infringement, libel and slander. The User shall not post, transmit through or otherwise make available via the Service (i) any material which violates or infringes in any way upon the rights of others, which is unlawful, defamatory, obscene, abusive, profane, vulgar, sexually explicit, racist, threatening, hateful or otherwise objectionable or which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, (ii) without the express written consent of the owner thereof, any copyrighted material, or (iii) without the express prior written consent of DataForce, any advertising or any solicitation with respect to products or services. Although DataForce does not and cannot review every message posted by User on the Service, DataForce shall be under no obligation to permit any material posted or transmitted by the User to remain on the Service, and may refuse to display or remove from the Service any material which DataForce, in the exercise of its sole discretion, believes violates this Agreement or any Operating Rules. Material (defined as messages, stories, articles, or website addresses) authored by User or a user authorized by User under this Agreement ("User Material") that is posted, transmitted through or otherwise made available on the Service by the User in public posting areas (such as feedback, chat rooms or forums) shall be considered to be in the public domain, and may be copied, published, distributed or otherwise used by DataForce (or another User) for any purpose without the permission of the User. User acknowledges that any User Material posted, transmitted through or otherwise made available on the Service may be edited, removed, modified, published, transmitted and displayed by DataForce, and User waives all moral rights in such User Material.

DataForce Fantasy Football Leagues are contests of skill. Winners are determined by the objective criteria listed in the League Rules. Winners are determined by the individuals who use their skill and knowledge of relevant sports information and fantasy sports rules to accumulate the highest point totals during the contest according the contest rules.

DataForce contests are subject to all United States laws, and to the DataForce official League Rules, and cannot be used in connection with any form of gambling. By entering any contest, you agree to abide by the terms of the official rules and by the decisions of DataForce, LLC, which are final on all matters pertaining to its games.

DataForce, LLC reserves the right to amend the official rules at any time, without limitation, in its sole discretion. In particular, contest rule changes, such as roster sizes, may be altered during the fantasy season in response to special circumstances, team eligibility or participation, schedule or rule changes in the NFL, including acts of God.

If, for any reason, a contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of DataForce, LLC which corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest, DataForce, LLC reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the contest. Cancelation of any contest will void all prizes and result in the return of all entry fees. DataForce, LLC assumes no responsibility for any error, omissions, interruption, deletion, defect or delay in operation with transmission, communications, line failure, theft or destruction or unauthorized access to or allegation of entries.

DataForce, LLC is not responsible for any disconnection during fantasy contest play, including any problem or technical malfunction of any telephone network or lines, computer online systems, servers, equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, phone lines, or any combination thereof, including any injury or damage to a participant's computer related to or resulting from participation in its contests.

Should a malfunction result in the display an incorrect or erroneous calculations of prize payouts or awards, DataForce, LLC is not responsible to honor such calculations.

Any attempt by a participant to deliberately damage any web site or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, DataForce, LLC reserves the right to seek damages to the fullest extent permitted by law.

DataForce hosts a portion of its leagues at MyFantasyLeague.com.

Such leagues will be run on that site unless a change is needed due to things beyond our control (change in cost of the league host site, league host site ceasing operation, league host site no longer working with rules we have in place, or many other reasons). In the event a league host may be changed, the league will be moved to the DataForce platform.

These Terms and Conditions shall also apply to the use of the DataForce Mobile Application. Subject to your compliance with these terms, DataForce, LLC grants you the right to download and install a copy of the DataForce Fantasy Football Application on a device that you exclusively operate and to run such a copy of the Application for your own personal use. If you have downloaded the DataForce Fantasy Football Application, you agree to promptly download and install any new version that we make available. You agree that your use of the DataForce Fantasy Football Application binds you to these terms and that these terms are between you and DataForce, LLC only. Any reference to the website or DataForce, LLC in general in these Terms and Conditions shall also be deemed to include the mobile application.

DataForce expressly reserves the right to immediately modify, suspend or terminate your account and refuse current or future use of any DataForce service, including the fantasy football service, if DataForce, in its sole discretion: (a) believes you have violated or tried to violate the rights of others; (b) becomes aware of information indicating a safety concern for you, other DataForce users, or the general public, or (c) believes that you have acted inconsistently with the spirit or letter of the Terms of Service or the Official Game Instructions.

DataForce fantasy football or other fantasy sports services and their related benefits are offered at the discretion of DataForce, and DataForce has the right to modify or discontinue, temporarily or permanently, any fantasy sports services, in whole or in part for any reason, with or without notice to you. You agree that DataForce will not be liable to you or to any third party for any modifications or discontinuance of the Service or the Premium Services.

You agree to indemnify and hold harmless DataForce, its subsidiaries, affiliates, officers, agents, or other partners, and employees, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of, or participation in, fantasy football or other fantasy sports services, your connection to fantasy football or other fantasy sports services provided by DataForce, your violation of the Terms of Service, the Official Game Instructions, or of any rights of another person or entity.

Participants are required to understand and follow the guidelines on DataForce's Player Protection Page for the protection of their account funds and personal information. DataForce is not responsible for theft of funds or identity.

To the fullest extent permitted by applicable law, participants understand and assume the ordinary risks of participating in DataForce contests, and agree to release, and not to sue, DataForce, its administrators, officers, employees, and other participants for any claims, demands, losses, or damages arising out of such participation, except to the extent such claims, losses, or damages result from DataForce's gross negligence, willful misconduct, or fraud. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Subject to the foregoing, and to the maximum extent permitted by law, in no event will the total liability of DataForce, LLC to any participant exceed the amount of that participant's contest entry fee(s), less the amount retained for prize payouts.

If any provision of these Additional Terms or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of such documents remain in full force and effect.

Agreement to Arbitrate. Except as expressly set forth below, you and DataForce, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service, the Operating Rules, your use of the Service, or any contest conducted by DataForce (a “Dispute”) shall be resolved exclusively through final and binding individual arbitration, rather than in court. This agreement to arbitrate is governed by the Federal Arbitration Act (9 U.S.C. §§ 1–16).

Class Action Waiver. You and DataForce agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of class or representative proceeding. You and DataForce waive any right to a trial by jury.

Arbitration Procedures. The arbitration will be administered by a neutral, nationally recognized arbitration administrator that maintains consumer arbitration rules, as mutually agreed upon by you and DataForce. If the parties cannot agree on an administrator, either party may petition a court of competent jurisdiction to appoint one. The arbitration will be conducted under that administrator’s consumer arbitration rules then in effect, as modified by these Terms, before a single arbitrator in the English language. Unless the parties agree otherwise, any in-person hearing will take place in Lincoln County, Oregon, USA, provided that the arbitrator may permit you to participate by telephone or video conference. The arbitrator’s award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Exceptions. Notwithstanding the foregoing, (a) either party may bring an individual action in small claims court for disputes within that court’s jurisdiction; and (b) either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property or other proprietary rights. Any matter not subject to arbitration under this section shall be brought exclusively in the courts identified in the “Location of Any Lawsuit” section below.

Fees. Payment of all filing, administration, and arbitrator fees will be governed by the administrator’s consumer arbitration rules then in effect, except that DataForce will reimburse such fees for any non-frivolous claim totaling less than $2500, as determined by the arbitrator.

Severability. If the Class Action Waiver above is found to be unenforceable as to a particular claim or request for relief, then that claim or request for relief (and only that claim or request for relief) shall be severed and brought in a court of competent jurisdiction as identified in the “Location of Any Lawsuit” section, while all other claims shall proceed in arbitration. If any other provision of this section is found unenforceable, it shall be severed and the remainder of this section shall remain in full force and effect.

Survival. This arbitration agreement will survive termination of your account or relationship with DataForce.

Except for disputes subject to the Mandatory Binding Arbitration and Class Action Waiver section above, you agree that any dispute arising out of gameplay conducted under these rules shall be resolved exclusively in the state and federal courts located within the county of Lincoln, Oregon, USA, consistent with the Location of Any Lawsuit provision below. DataForce will continue to observe the posted fantasy sports laws and regulatory requirements of your home state where such laws exist.

The DataForce Terms of Service, which apply to your use of fantasy football or other fantasy sports services, provide that both you and DataForce agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Lincoln, Oregon, USA. The DataForce Terms of Service and the relationship between you and DataForce will be governed by the laws of the State of Oregon, without regard to its conflicts of law provisions.

DataForce, LLC contains copyrighted material, and the entire contents of the Service are copyrighted as a collective work under the United States copyright laws. Except as expressly permitted by this Agreement or the Operating Rules, the User may not copy, reproduce, publish, retransmit or redistribute copyrighted materials, in whole or in part, in any manner, without the express written permission of the copyright owner. The User may download or make a single copy of copyrighted materials solely for the User's own personal use, provided the User preserves any copyright or other notices contained in or associated with them.

DataForce, LLC is not responsible for any late, lost, garbled, misdirected, incomplete, or damaged entries; any contest disruptions, injuries, losses or damages caused by events beyond the control of DataForce, LLC or any printing or typographical errors in any materials associated with any contest. These contests and the DataForce web site are not sponsored or endorsed by the National Football League.

THE USER AGREES THAT THE USE OF THE SERVICE, AND ANY SOFTWARE OBTAINED THROUGH OR IN CONNECTION WITH THE SERVICE ("SOFTWARE"), IS AT THE USER'S SOLE RISK. NEITHER DATAFORCE,LCC, ITS CONTENT PROVIDERS NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS OR LICENSORS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT SOFTWARE WILL BE ERROR-FREE; NOR DO DATAFORCE, LLC OR ANY OF THE FOREGOING PERSONS MAKE ANY WARRANTY AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SOFTWARE, PRODUCTS OR SERVICES PROVIDED THROUGH THE SERVICE OR THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE. THE SERVICE AND ANY SOFTWARE ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; AND DATAFORCE, LLC HEREBY EXPRESSLY DISCLAIMS, ON ITS OWN BEHALF AND ON BEHALF OF ITS CONTENT PROVIDERS SUCH OTHER PERSONS, ALL WARRANTIES OF ANY KIND, OTHER THAN THOSE WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSIONS, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT. THE USER'S SOLE REMEDY FOR ANY DAMAGES CAUSED OR ALLEGEDLY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, OR OTHER CAUSE, SHALL BE TO TERMINATE THE USER'S ACCOUNT.
